However, creditors are only entitled to this right if they demonstrate that the merger jeopardises the fulfilment of their claim. The creditors of the company whose claims have been substantiated before the entry of the termination of the contract in the commercial register according to § 10 HGB is deemed to have been disclosed shall be provided with security by the other part of the contract if they make a notification to him for that purpose within six months of the notice.
