It shall be made known as unregistered: if the creditors of the entities participating in the spin-off are deemed to have been made known in writing within six months of the date on which the entry of the division in the register of the registered office of the legal entity of which they are creditors is deemed to have been made known in accordance with § 19 Abs. 3 UmwG, they shall be required to file their claim in accordance with the reason and amount, in so far a.s. they are unable to claim satisfaction. However, creditors are only entitled to this right if they make it credible that the separation endangers the fulfilment of the claim.
