In dem Rechtsstreit Herbert Dross gegen Klöckner-Werke AG, Landgericht Duisburg, Aktenzeichen 22 O 105/07 hat der Kläger die Anfechtungsklage gegen die von der Hauptversammlung 2007 gefassten Beschlüsse über die Entlastung von Vorstand und Aufsichtsrat zurückgenommen. Die Beklagte hat dem Kläger erklärt, dass sie für den Fall der Klagerücknahme keinen Kostenantrag stellt.
