Corporate purpose
In the area of compulsory storage, CARBURA pursues the following purposes under private law: a) It is a self-help organisation of compulsory stockholders and has the purpose of carrying out certain tasks assigned to it by the compulsory warehousekeepers in accordance with their common interests. The association itself cannot be a compulsory stockholder. (b) protect its members against financial losses arising from compulsory stockpiling; To this end, it maintains special funds. (c) it may participate in companies which operate joint compulsory storage, provide tank space for compulsory storage or otherwise serve the compulsory storage of mineral oil; Such companies must be subject to appropriate control. CARBURA aims in particular to carry out the following public law tasks assigned to it by the Confederation in connection with the implementation of compulsory storage of mineral oils: a) It issues general import licences on behalf of and in accordance with the instructions of the Confederation and supervises the import and taxation of liquid fuels with a view to carrying out compulsory stockpiling. b) It monitors the compulsory storage of liquid fuels on behalf of and in accordance with the instructions of the Confederation. c) It carries out inventories and surveys concerning the national economic supply within the meaning of Article 62 of the State Supply Act (LVG) and Article 9 of the Ordinance on the Compulsory Storage of Liquid Fuels and Fuels (Mineral Oil Compulsory Storage Ordinance). In the interest of its members, CARBURA aims to prepare and implement measures for national economic supply: a) It informs the authorities about the state of supply of liquid fuels. b) It participates in the planning and implementation of measures for national economic supply. (c) In times of disturbed supply, it may carry out joint arrangements for the procurement of goods. Such provisions, unless ordered by the Confederation, are binding only on those members who have agreed to them. These precautions are exclusively at the expense and risk of the companies involved. CARBURA may participate in the planning and implementation of other tasks in the mineral oil sector that are in the interest of the country, insofar as this is done on behalf of or with the approval of federal authorities. Insofar as these tasks are not related to the national economic supply, CARBURA itself is entitled to decide on a case-by-case basis whether they should be taken over. Such other voluntary tasks are carried out by it exclusively at the expense and risk of the companies involved. CARBURA may conclude agreements with the gas industry for the storage of gas replacement storage facilities by CARBURA members. The costs are charged to the gas industry. CARBURA can carry out all activities that are related to the purpose of the association or promote this purpose. Liquid fuels within the meaning of these statutes are the products listed in the Annex to the Mineral Oil Compulsory StockPiling Ordinance. The association does not conduct commercial transactions and does not intend to make a profit.
